These Terms and Conditions ("Terms") govern your use of the Savista website and any purchases made through it.

By using this Website or purchasing a product, you agree to these Terms. If you do not agree, please do not use the Website or make a purchase.

1. About Savista

This Website is operated for the musical group professionally known as Savista, based in Toronto, Ontario, Canada.

In these Terms, "Savista", "we", "us" and "our" refer to the musical group professionally known as Savista and those authorized to operate the Website and provide services on its behalf.

The Website is available at www.savista.ca and is referred to in these Terms as the "Website".

"You" means any person or organization accessing or using the Website.

2. Website Purpose and Band Information

The Website provides information about Savista, including music, media, performances and band-related services.

Information about the band, its availability, performances, services or booking options is provided for general information and promotional purposes.

Submitting a contact form, email or booking inquiry does not create a booking, contract or obligation for Savista to perform.

A performance or other service is confirmed only when the applicable booking terms have been agreed to by the parties and any required contract, deposit or payment requirements have been completed.

We may decline any booking or service inquiry at our discretion.

3. Website Use

You may use the Website only for lawful purposes.

You must not:

misuse or interfere with the Website;

attempt to gain unauthorized access to the Website or its systems;

introduce viruses, malware or other harmful technology;

use automated systems to improperly scrape or copy Website content; or

use the Website in a way that violates applicable law or the rights of another person.

We may restrict or terminate access to the Website where we reasonably believe these Terms have been violated.

4. Digital Music and Downloads

The Website may offer music or other digital content for download.

Certain digital products may use a "pay what you want" pricing model. Where this option is offered, you may choose the amount you wish to pay, subject to any minimum amount displayed at checkout.

The amount you select and confirm at checkout is the purchase price for that transaction.

Digital products are licensed to you for personal, non-commercial use only unless we expressly agree otherwise in writing.

Purchasing or downloading digital content does not transfer ownership of any copyright, recording, composition, artwork, trademark or other intellectual property.

You may not reproduce, resell, redistribute, upload, sublicense or commercially exploit purchased digital content without permission from the applicable rights holder.

Because digital products are made available electronically, digital purchases are generally final once the download or access has been provided, except where a refund or other remedy is required by applicable law.

If you experience a technical problem receiving or accessing a purchased download, please contact us and we will make reasonable efforts to resolve the issue.

5. Merchandise

The Website may sell merchandise, including clothing and other physical products.

Many merchandise products are produced on demand and fulfilled by a third-party fulfilment provider, currently Printful.

Product images are provided for illustration. Minor differences in colour, positioning, sizing or appearance may occur due to screens, printing methods and manufacturing processes.

Please review product descriptions and sizing information carefully before placing an order.

6. Orders

By placing an order, you confirm that:

the information you provide is accurate and complete;

you are legally capable of entering into the purchase;

you are authorized to use the payment method provided; and

you agree to pay the total amount displayed at checkout.

An order confirmation does not prevent us from cancelling an order where there is a payment problem, suspected fraud, product availability issue, pricing error or other reasonable operational issue.

If we cancel an order after payment has been successfully collected, the applicable amount will be refunded.

7. Prices, Currency and Taxes

Prices are displayed in the currency shown on the Website or at checkout.

Prices may change at any time before an order is completed.

Applicable taxes, shipping charges and other fees will be displayed or calculated at checkout where applicable.

For international purchases, your bank or payment provider may charge currency conversion or other transaction fees. We do not control these fees.

8. Payments

Payments are processed through Stripe or another payment provider identified at checkout.

We do not directly process or store complete payment card details on our own systems where payment information is handled by our payment provider.

Your payment may be subject to authorization, fraud prevention and security checks by Stripe, your card issuer or other applicable payment providers.

We are not responsible for delays or declined transactions caused by a payment provider or financial institution.

9. Shipping and Delivery

Physical merchandise may be fulfilled and shipped by Printful or another third-party fulfilment provider.

We may ship to Canada and other international destinations where shipping is reasonably available.

Shipping availability, cost and estimated delivery times depend on the product, destination, fulfilment location and shipping carrier.

Delivery dates are estimates unless expressly stated otherwise. Delays may occur because of carriers, customs, weather, labour disruptions or other circumstances outside our reasonable control.

Nothing in these Terms limits any delivery rights or remedies you may have under applicable consumer protection law.

You are responsible for providing a complete and accurate shipping address.

Additional charges resulting from an incorrect or incomplete address may be the customer's responsibility where permitted by law.

10. International Orders, Customs and Duties

International orders may be subject to customs processing, import duties, taxes, tariffs or other charges imposed by the destination country.

Unless stated otherwise at checkout, these charges are not included in the product or shipping price and are the customer's responsibility.

We do not control customs authorities or customs processing times.

You are responsible for ensuring that a product may legally be imported into your country or region.

11. Returns, Refunds and Product Problems

Because merchandise is generally produced on demand, we do not normally accept returns or exchanges for change of mind, incorrect size selection or an incorrectly ordered product, except where required by applicable law.

If an item arrives damaged, defective or misprinted, please contact us within 30 days of receiving the product.

Please include:

your name;

order information;

a description of the problem; and

clear photographs showing the issue where reasonably requested.

If a package appears to be lost in transit, please contact us no later than 30 days after the estimated delivery date.

We will review the issue with our fulfilment provider. Where a manufacturing, printing, fulfilment or qualifying shipping problem is confirmed, we may provide a replacement or refund, as appropriate.

Do not return merchandise directly to us or to Printful unless return instructions have first been provided.

Nothing in this section limits any rights or remedies available to you under applicable consumer protection law.

12. Order Cancellations

Orders may enter production shortly after payment is completed.

Because many merchandise products are made on demand, we cannot guarantee that an order can be changed or cancelled after it has entered production.

If you need to request a change or cancellation, contact us as soon as possible.

Digital purchases generally cannot be cancelled after the digital content has been delivered or made available, except where required by applicable law.

13. Intellectual Property

Unless otherwise stated, the Website and its content are owned by or used with permission of Savista or the applicable rights holders.

This includes, without limitation:

music and sound recordings;

musical compositions and lyrics;

photographs and video;

artwork and graphics;

logos and band names;

merchandise designs; and

Website text and other content.

You may view and use Website content for personal, non-commercial purposes.

You may not copy, reproduce, distribute, sell, modify or commercially exploit Website content without prior permission from the applicable rights holder.

All rights not expressly granted are reserved.

14. Third-Party Services and Links

The Website may use or link to third-party services, including payment processors, fulfilment providers, shipping carriers, music platforms and social media services.

These third parties operate independently and may have their own terms and privacy policies.

We are not responsible for third-party websites, services or content that we do not own or control.

15. Privacy

Your use of the Website is also subject to our Privacy Policy.

Our Privacy Policy explains how personal information may be collected, used and disclosed in connection with the Website, purchases, inquiries and related services.

To the maximum extent permitted by applicable law, Savista and those acting on its behalf, including representatives, contractors and service providers, will not be liable for indirect, incidental, special or consequential losses arising from your use of the Website or a product purchased through it.

Where liability cannot legally be excluded, liability will be limited to the greatest extent permitted by applicable law.

For claims relating directly to a purchase, total liability will not exceed the amount you paid for the product or transaction giving rise to the claim, except where a greater remedy is required by law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

18. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims or reasonable costs arising directly from your unlawful misuse of the Website or your material violation of these Terms.

19. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Any dispute will be subject to the courts of Ontario, Canada, unless applicable consumer protection law gives you the right to bring a claim in another jurisdiction.

Mandatory consumer rights that apply to you are not excluded by these Terms.
